Lasting Powers of Attorney

LASTING POWER OF ATTORNEY (LPA)

Lasting Powers of Attorney are equally as important as making a Will - they relate to decisions which need to be made during your lifetime. Many think LPAs are only of interest to the elderly generation. Quite the contrary in fact.

Many of us will, at some point in the future, have a good use for having a Lasting Power of Attorney in place. Whether this is while you are on holiday; unwell or in the case of a stay in hospital.

There are two different types of Lasting Power of Attorney:-

Property and Financial Affairs- This relates to your home, your money, your savings and your income. Essentially anything you can do with your own money, your Attorney(s) will be able to do on your behalf, if the need arises. Your Attorney(s) can (if this option is selected in the LPA) help you, under your direction. This can cater for the situation where you are physically unable to undertake a task but retain the ‘mental capacity’ to make the decision in question.

Health and Welfare- These decisions relate to your health and care. These Powers of Attorney can only be used if you are unable to make these decisions yourself and provide your Attorney(s) with the legal authority to speak as if they are you, about any health or care decision which needs to be made on your behalf. Your Attorney(s) can (if this option is selected in the LPA) speak to Doctors as if they are you in the decision making for Life Sustaining Treatment. This means an urgent medical decision which needs to be made relating to treatment to keep you alive.

Once the Lasting Powers of Attorney have been signed by you and your Attorneys, they must be registered at the Office of the Public Guardian before they can be used. We will assist you with this process.

We aim, so far as possible, to have fixed fees for Lasting Powers of Attorney and the following is a guideline of expected costs:-
* Single person making LPA for Property and Financial Affairs OR Health and Welfare £200
* Single person making both Lasting Powers of Attorney £300
* Couple both making one LPA for property and financial affairs OR Health and Welfare £300
* Couple both making both Lasting Powers of Attorney £400

The standard fee payable upon registration of each LPA at the Office of the Public Guardian is £82. If you need help with the cost of registering your LPA you may be entitled to:-
* A full Exemption or
* A 50% Remission/discount
both of these applications are means tested
