LPA - HEALTH AND WELFARE
Lasting Powers of Attorney (LPA) are legal documents that allow you, the donor, to appoint one or more people – your Attorney(s) – to help you make decisions or make choices on your behalf if you can no longer make them. An LPA can relate to Health and Welfare and Property and Finance.
A Health and Welfare LPA concerns your health and care. During your lifetime, if you can no longer make decisions for your health and care, your Attorneys can take over decisions relating to these concerns on your behalf.
This type of LPA can only be used if you lack the mental capacity to make these decisions. Mental capacity means the understanding of an issue and weighing up of the pros and cons of that issue, to arrive at a decision.

Without a registered Health and Welfare LPA, medical professionals will make decisions on your behalf. Spouses, common-law partners or family members will have to apply to the Court for a Deputy Order to represent you.
