A Will acts as your voice once you have passed away, unlike a Power of Attorney which allows others to assist you whilst you’re alive. A Will is a legally binding document which ensures the instructions for who you want to inherit your money, property and assets (your estate) are appropriately managed and followed.

A Will acts as your voice once you have passed away, unlike a Power of Attorney which allows others to assist you whilst you’re alive. A Will is a legally binding document which ensures the instructions for who you want to inherit your money, property and assets (your estate) are appropriately managed and followed.
If a person dies without a Will in place, the law of intestacy will decide on your behalf who inherits your estate, based on your family connections. The rules do not take into account the closeness of your relationships, or who you consider most in need. For example, if you are not married or have not formed a civil partnership, without a Will, your partner will not automatically inherit your estate – regardless of how long you have been together.
In your Will you appoint one or more Executors – the person or people you want to manage the administration of your estate. Executors also control monies if the people you leave your estate to (the beneficiaries) are under 18. Working on your behalf, your Executors carry out the instructions you have left in your Will.

Who do they want as their beneficiary?
Some people like to leave a certain amount of money to family, friends, a charity or organisation.
You may want to safeguard your share of your home for your children against a partner or spouse remarrying. Trusts also help mitigate care home fees.
If there are more than one, consider whether each beneficiary will inherit equally, or unequally.
Do you have strong opinions on how you would like your funeral to be conducted? For example, do you want to be cremated or buried in a religious or non-religious ceremony? You can confirm your choices in your Will to ensure your requests are fulfilled.
